Terms and Conditions
In these Terms and Conditions, the words "us", "we", and "our" refer to Epsilon Web Manufactory, the owner of the following websites, products, and services:
- Websites: https://fulltextsearch.org, https://e-wm.org, https://textmill.io
- Products: WP Fulltext Search plugin (also referred to "WPFTS", "WPFTS Pro") and all official add-ons and extensions developed for WordPress
- Services: The services we offer when you contact WPFTS Support
These Terms and Conditions affect your legal rights and obligations. If you do not agree to be bound by all of these Terms and Conditions, do not access or use our websites, products, or services.
Users of our websites, products, and services must be above the age of 13.
Our products are licensed under the current version of the GNU General Public License (GPL) (http://www.gnu.org/licenses/gpl.html).
As a license holder of our products, you cannot distribute, freely give away, or resell your license key. You may not transfer the license key to a new owner.
You must use your license on websites that you own or manage. You may use your license on a client site in situations in which you maintain an ongoing relationship with your client as a consultant. By using your license on a client site, you acknowledge and agree that your client will come to you for support.
Any third-party libraries in our products are subject to their own licensing. You are responsible for reviewing and following third-party licenses, terms, and conditions.
2. Payments and Price Changes
When you purchase a product, you are actually purchasing a membership subscription for WP Fulltext Search plugin and TextMill.io service, which gives you access to product updates, technical support, and TextMill.io services for a period of one year following the date of purchase.
All products that you purchase are added to a single membership with a single license key. Each product subscription included in your membership is due for renewal one year from the date of purchase.
We reserve the right to modify or discontinue, temporarily or permanently, prices of all products or subscriptions, including monthly or annual subscription fees, at any time with or without notice. Such notice may be provided at any time by posting the changes to this Terms and Conditions. All prices are in U.S. dollars.
3. Refund Policy
Although we don’t think you’ll ever want a refund, we gladly refund your purchase if it’s requested within 30 days. No refunds will be given after 30 days from the initial purchase under any circumstances.
4. Product Updates and Support
Product updates are released as often as needed for bug fixes, compatibility, or feature additions.
Online support is offered through Live Chat widget on the main page of the fulltextsearch.org website and via email. We do not offer phone support, nor do we offer support or otherwise for the installation, customization or administration of WordPress itself or third-party applications.
Our products continue to function if your subscription expires, but you lose the ability to get product updates, download newer versions of the product, access to support and use TextMill.io services. If your membership has expired, in order to get an update or technical support you must renew your annual membership subscription, regardless of the situation or circumstance. When you renew the subscription, you can get up to a 25% discount (it depends on the number of remaining days).
5. Newsletter and Email
We may on occasion send you important email notifications related to your plugin licenses. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices and other transactional emails related to your purchases. You cannot unsubscribe from these account notices.
All of our products, with the exception of any third-party components contained in the products, are the property of Epsilon Web Manufactory. You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified.
7. Termination and Cancellations
Epsilon Web Manufactory, in its sole discretion, has the right to suspend or terminate your account for violation of the Terms and Conditions and refuse any and all current or future use of the service or products provided by us. Termination will result in the deactivation or deletion of your account and access to your account, including the deactivation or deletion of all content in your account.
Epsilon Web Manufactory reserves the right to refuse services or products to anyone for any reason at any time, refund your payment, and terminate your account if deemed necessary.
If you are dissatisfied with any aspect of our services or products and wish to terminate your account voluntarily, you may do so by contacting us, but no refund will be provided beyond 30 days after purchase. When you voluntarily terminate your account, we will deactivate and delete it and all content contained in it.
8. Warranty and Liability
We guarantee our products to function as advertised when installed on a clean, self-hosted installation of WordPress and when activated without any changes. We cannot guarantee our products will function with all third-party components, plugins or web browsers.
Beyond this guarantee, we provide our products “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.
Epsilon Web Manufactory's aggregate liability under or in connection with the Terms and Conditions will be limited to the amount paid for the services or products if any. This limitation will apply even in the event of a fundamental or material breach of these Terms and Conditions.
You agree to indemnify and hold Epsilon Web Manufactory, officers, directors, employees and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from content you submit, post, transmit or otherwise make available through use of our services or products, your connection to our service or products, your violation of the Terms and Conditions, or your violation of any rights of another.
